These Terms & Conditions ("Terms") govern your use of the Apache Pizza website (https://apachepizac.com) and mobile application (collectively, the "Platform"), as well as the products and services offered by Apache Pizza ("we", "our", or "us").
Please read these Terms carefully before using our Platform. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Platform.
1.1. To place orders through our Platform, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
1.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
1.3. We reserve the right to suspend or terminate your account if any information provided during registration or thereafter proves to be inaccurate, false, or outdated, or if you have violated these Terms.
2.1. When you place an order through our Platform, you are offering to purchase the products you have selected. All orders are subject to acceptance and availability.
2.2. We reserve the right to refuse or cancel any order for any reason, including but not limited to: product availability, errors in product or pricing information, or problems identified by our fraud and credit risk department.
2.3. Payment for all orders must be made at the time of ordering. We accept various payment methods as indicated on the Platform.
2.4. The prices displayed on our Platform include VAT but exclude delivery charges, which will be added at checkout. Prices are subject to change without notice.
2.5. Promotional offers, vouchers, and discounts cannot be used in conjunction with any other offer unless explicitly stated in the terms of the promotion.
3.1. We offer delivery to eligible areas within our delivery zones. Delivery areas may vary by restaurant location.
3.2. Delivery times provided are estimates only and are not guaranteed. Factors outside our control, such as traffic conditions and weather, may affect delivery times.
3.3. A delivery fee may apply to your order, which will be clearly displayed before you complete your purchase.
3.4. You must provide accurate and complete delivery information. If we cannot locate the delivery address or if no one is available to accept delivery, we reserve the right to leave the order in a safe place or return it to the restaurant, and you may be charged for the order.
4.1. All content on our Platform, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of Apache Pizza or its content suppliers and is protected by international copyright and other intellectual property laws.
4.2. Our trademarks, logos, and service marks displayed on the Platform are our registered and unregistered trademarks. You may not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify these trademarks in any way without our prior written consent.
4.3. We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our Platform for personal, non-commercial purposes.

6.2. By posting User Content, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.
6.3. You represent and warrant that your User Content does not violate any third-party rights, including intellectual property rights and privacy rights, and complies with these Terms and all applicable laws and regulations.
6.4. We reserve the right to remove any User Content that, in our judgment, violates these Terms or is otherwise objectionable.
7.1. We strive to display our products and their features as accurately as possible. However, the actual colors, dimensions, and details you see on-screen may vary depending on your monitor.
7.2. All products are subject to availability. We reserve the right to discontinue any product at any time.
7.3. Our menu, ingredients, and nutritional information are subject to change without notice.
7.4. If you have allergies or special dietary requirements, please contact the restaurant directly before placing your order. While we take reasonable steps to minimize the risk of cross-contamination, we cannot guarantee that any of our products are allergen-free.

To the maximum extent permitted by law, Apache Pizza, its affiliates, and their respective officers, directors, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
8.2. In no event shall our total liability to you for all claims arising from or related to your use of our Platform or services exceed the amount paid by you to us in the 12 months preceding the event giving rise to the liability.

You agree to indemnify, defend, and hold harmless Apache Pizza, its affiliates, and their respective officers, directors, employees, agents, suppliers, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform.
10.1. These Terms shall be governed by and construed in accordance with the laws of Ireland, without giving effect to any principles of conflicts of law.
10.2. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of Ireland, and you consent to the personal jurisdiction of such courts.
11.1. We may revise these Terms from time to time. The most current version will always be posted on our Platform, with the "Last Updated" date at the top.
11.2. Your continued use of the Platform after we post any modifications to the Terms will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Terms.
12.1. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms will remain in full force and effect.
13.1. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
14.1. These Terms, together with our Privacy Policy and any other legal notices published by us on the Platform, constitute the entire agreement between you and Apache Pizza concerning the Platform.
